Welcome to Ophraxx! These Terms of Service ("Terms", "ToS") govern your use of the Ophraxx Discord bot ("the Bot", "Service", "we", or "us"). By adding Ophraxx to your Discord server or using any of its features, you agree to be bound by these Terms.

1. Acceptance of Terms

1.1 Agreement to Terms

By inviting Ophraxx to your Discord server, executing any commands, or otherwise accessing the Service, you agree to:

• Be bound by these Terms of Service
• Comply with our Privacy Policy
• Follow Discord's Terms of Service and Community Guidelines
• Accept any future modifications to these Terms

1.2 Age Requirements

You must be at least 13 years old (or 16 in the European Union) to use Ophraxx, in accordance with Discord's Terms of Service. If you are under 18, you must have parental or guardian consent to use the Service.

1.3 Authority to Agree

By adding Ophraxx to a Discord server, you represent that you have the authority to bind that server and its members to these Terms. If you are acting on behalf of an organization, you represent that you have the authority to bind that organization.

2. Description of Service

2.1 What Ophraxx Provides

Ophraxx is a free Discord moderation bot that provides:

• Automated and manual moderation tools
• Server security and protection features
• Logging and analytics capabilities
• Configuration and customization options
• Utility and information commands

2.2 Service Availability

While we strive for 99.99% uptime, Ophraxx is provided "as is" without guarantees of availability. We reserve the right to:

• Modify or discontinue features at any time
• Perform maintenance with or without notice
• Temporarily suspend service for updates or repairs
• Change, limit, or restrict access to the Service

2.3 No Cost Service

Ophraxx is completely free to use. We do not charge fees, require subscriptions, or operate on a freemium model. All features are available to all users at no cost.

3. User Responsibilities

3.1 Acceptable Use

When using Ophraxx, you agree to:

• Use the Bot for lawful purposes only
• Respect Discord's Terms of Service and Community Guidelines
• Use moderation features responsibly and fairly
• Not abuse, exploit, or misuse the Bot's features
• Not attempt to reverse engineer or decompile the Bot
• Not use the Bot to harass, abuse, or harm other users
• Comply with all applicable local, state, national, and international laws

3.2 Prohibited Activities

You explicitly agree NOT to:

• Abuse or Spam: Use the Bot to spam commands, flood channels, or create excessive requests
• Circumvention: Attempt to bypass rate limits, restrictions, or security measures
• Malicious Use: Use the Bot for DDoS attacks, server raids, or malicious activities
• Data Scraping: Use the Bot to harvest user data or server information for unauthorized purposes
• Impersonation: Impersonate Ophraxx staff, developers, or official support
• Exploitation: Exploit bugs, vulnerabilities, or glitches for personal gain
• Interference: Interfere with or disrupt the Bot's operation or servers
• Resale: Sell, trade, or commercialize access to the Bot

3.3 Server Administrator Responsibilities

As a server administrator using Ophraxx, you are responsible for:

• Configuring the Bot appropriately for your server
• Ensuring your moderators use the Bot responsibly
• Reviewing and managing moderation logs
• Complying with Discord's Terms of Service
• Informing your server members about the Bot's presence and data collection

4. Moderation and Enforcement

4.1 Right to Moderate

We reserve the right to:

• Monitor Bot usage for violations of these Terms
• Investigate reports of abuse or misuse
• Take action against users or servers violating these Terms
• Remove the Bot from servers engaging in prohibited activities

4.2 Enforcement Actions

Violations of these Terms may result in:

• Warning: Formal notice of violation with requirement to cease
• Temporary Suspension: Temporary removal of Bot access (7-30 days)
• Permanent Ban: Permanent removal from your server with blacklist
• Feature Restrictions: Limiting access to specific Bot features
• Reporting: Reporting severe violations to Discord Trust & Safety

4.3 Appeals Process

If you believe enforcement action was taken in error, you may appeal by:

• Joining our support server and opening a ticket
• Providing relevant details and evidence
• Waiting for review by our moderation team (typically 3-5 business days)

5. Intellectual Property

5.1 Ownership

Ophraxx and all related materials, including but not limited to:

• Source code and algorithms
• Bot name, logo, and branding
• Documentation and guides
• Website and related content

Are owned by Ophraxx and protected by intellectual property laws. All rights not expressly granted are reserved.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Ophraxx solely for its intended purpose in your Discord server. This license does not grant you:

• The right to modify or create derivative works
• The right to reverse engineer the Bot
• The right to redistribute or resell the Bot
• Any ownership rights to the Bot or its components

5.3 Trademarks

The "Ophraxx" name, logo, and related marks are trademarks of Ophraxx. You may not use these marks without prior written permission.

6. Data and Privacy

6.1 Data Collection

By using Ophraxx, you acknowledge and agree to our data collection practices as outlined in our Privacy Policy. You represent that you have obtained necessary consents from your server members.

6.2 Data Security

While we implement reasonable security measures, you acknowledge that:

• No system is 100% secure
• Data breaches may occur despite our best efforts
• You use the Service at your own risk
• We are not liable for unauthorized access to data

6.3 Data Retention

We retain data as described in our Privacy Policy. You may request data deletion at any time by removing the Bot or contacting support.

7. Disclaimers and Limitations

7.1 No Warranty

We are not liable for any interruptions, delays, or failures in service caused by:

• Discord API outages or limitations

You agree to indemnify, defend, and hold harmless Ophraxx, its developers, staff, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Bot
• Your violation of these Terms
• Your violation of any third-party rights
• Actions taken by your server moderators using the Bot
• Content posted in your server while using the Bot

9. Third-Party Services

9.1 Discord Platform

Ophraxx operates on the Discord platform and is subject to Discord's Terms of Service. We are not responsible for Discord's actions, policies, or service availability.

9.2 Third-Party Links

The Bot may contain links to third-party websites or services. We do not endorse or control these services and are not responsible for their content or practices.

9.3 Infrastructure Providers

We use third-party infrastructure providers (AWS, Cloudflare, etc.). Their terms and policies may also apply to your use of the Service.

10. Termination

10.1 Termination by You

You may terminate your use of Ophraxx at any time by:

• Removing the Bot from your Discord server
• Ceasing all use of Bot commands and features

10.2 Termination by Us

We reserve the right to terminate or suspend your access to Ophraxx immediately, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activities
• Abuse of the Service
• Any reason at our sole discretion

10.3 Effects of Termination

Upon termination:

• Your right to use the Bot immediately ceases
• Your data may be deleted in accordance with our Privacy Policy
• Sections of these Terms that should survive will remain in effect

11. Changes to Terms

11.1 Right to Modify

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date
• Material changes will be announced in our support server
• Continued use after changes constitutes acceptance
• You should review Terms periodically
